A Divorce is a difficult time for all involved, including the children. Our members recognize this and will take much of the burden off your shoulders. Everyone wants a quick, easy divorce. Unfortunately, there are important personal and financial matters that must be dealt with. Some divorces are quick and easy, but most require thoughtful consideration and compromise to ensure a fair and equitable result. The end result is often predictable once full disclosure of the financial and children issues are known. Most divorces are now resolved through a mediation process involving the clients, their attorneys and a competent mediator. Types of Divorce, Uncontested Divorce: A divorce is “Uncontested” when both parties agree to ALL issues. A Separation Agreement is signed by both parties and submitted to the Court for approval and the Final Judgment granting the Divorce. Contested Divorce: Your divorce is “Contested” if there is any issue that is not agreed to. Most contested divorces are resolved at mediation. However, if the parties do not reach agreement the final decision on all property and children issues will be made by the Judge after a trial that includes presenting witnesses and exhibits to the Judge so he or she fully understands the situation .Although we prefer to settle cases without a trial, at GGLC we understand and efficiently prepare for a Divorce trial if it is necessary. Other Family Law Matters: Sometimes it is necessary to address other family matters through the courts. These may include, paternity actions to establish a father’s rights, child support obligations and, of course, visitation and custody. Unfortunately parents and children sometimes have to deal with the Department of Children and Family Services through “Dependency” or “Delinquency” Proceedings. Jason K. Under Florida Law the father of a child born out of wedlock has very few rights with respect to that child until he has his paternity established through a Court proceeding.

Often this is done by the Florida Department of Revenue, which is the agency that seeks child support for unwed mothers or fathers in need. If the Department of Revenue has filed a child support case the father needs to ensure that the child support established is the proper amount. Child support varies significantly depending on the parenting time each spends with the child.

Every paternity case should include a Parenting Plan as well as the establishment of appropriate support obligations. Once a paternity determination is made it usually cannot be reversed. The child support and Parenting Plan continue throughout the child’s first 18 years!

Contracts have been a part of our business and personal lives from the beginning of time.

When a Contract is put in writing it enables everyone involved to understand and analyze the terms and conditions.

At Golden Gate Legal Center we believe the people who sign the Contracts should be able to understand the Contracts. Our Contracts are written in everyday language. The Contract needs to deal with all issues that are reasonably foreseeable. A properly written Contract will avoid litigation because of its clarity.

There is a popular misconception that Contracts “aren’t worth the paper they are written on”. Our experience says otherwise. If your signature is on a document you had better be prepared to be held accountable for the terms and obligations of that document.

Trust litigation entails legal disputes over a trust, among beneficiaries and trustees.

Every Florida trust names a trustee. A trustee is accountable for dispensing and administering belongings held in a trust to beneficiaries according with the terms of a trust.

Beneficiaries of a trust are folks that obtain belongings from a trust.

Trustees owe a legal fiduciary obligation to the beneficiaries of a trust including:

• An obligation of complete disclosure
• An obligation of loyalty, and,
• An obligation of care.

Child support refers to the sum that the noncustodial parent must pay to the custodian. This sum serves as a parental contribution for the child's basic living expenses, such as food, clothing, shelter, health care, and education. When a court orders a parent to pay child support, the parent must pay directly to the child's custodian rather than directly to the child. States generally do not impose an obligation to pay support for a child after that child has reached the age of 18.

An individual, however, only has a legal responsibility to support one's own biological children. Thus, a court cannot order an individual to pay child support for a stepchild, subject to the caveat that the individual did not formally adopt the stepchild. While the vast majority of states adhere to this rule, a few state statutes differ with regard to stepchild support.

Landlord–tenant law generally recognizes differences between residential and commercial leases on the assumption that residential leases present much more of a risk of unequal bargaining power than commercial leases.

Residential leases are contracts that are designed for individuals or groups to live, or reside, in the leased space. Most governmental entities have "recognized the sanctity of the home." Therefore, lessees of residential spaces are generally afforded more rights and protections than commercial leases. It is also because of the presumption of unequal bargaining power that residential spaces are afforded more protections. States, counties, and cities have different laws, and likewise, varying levels of protections for the tenants and landlords of commercial spaces.

Commercial leases are leases for spaces that are for business uses, such as industrial, office, retail, and manufacturing. Commercial leases generally have fewer consumer protections than residential leases because they are subject to much more negotiation.
